Amendments to the law on rental of residences for tourism purposes

On November 2, amendments to the law were finally published.

Here are the main points of changes:

• Rental of residential premises for a period of less than 100 days was included in the category “rental of residential premises for tourism purposes”

• To rent residential premises for these purposes, it is necessary to obtain a license from the Ministry of Culture and Tourism before concluding a lease agreement. According to the law, the Ministry of Culture and Tourism can also issue permit certificates through governors. In this regard, signs with qualifications determined by the Ministry will be posted at the entrances to rental houses

• The fee for issuing licenses and plates will be determined by the ministry. If the accommodation rented for tourism purposes is an apartment in a building, then in order to obtain a permit it is necessary to submit to the Ministry the consent of all owners on the floors in this building, users are prohibited from renting out housing rented from the license holder to third parties on their own behalf.

• Those who rent out houses for tourism purposes without the appropriate permit will be subject to an administrative fine of 100,000 (one hundred thousand) Turkish Liras for each rented house and will be given 15 days to carry out activities on the basis permission received

• After the 15-day period, persons who continue to engage in the rental of tourist houses without permission will be subject to an administrative fine of 500,000 (five hundred thousand) Turkish Liras and another 15 days will be given to carry out activities with obtaining permissions.

• An administrative fine of 1,000,000 (one million) Turkish Liras will be imposed on those who continue to operate tourist services without permission, despite the expiration of the second 15 days.
